Country House's trainer Bill Mott, who got his first Kentucky Derby win, said: "I know the stewards had a very, very hard decision and I'm glad I wasn't in their shoes".

The Derby is the first leg of the famous Triple Crown, which moves on to the Preakness Stakes at Pimlico Racecourse in Baltimore on May 18 before the final leg at Belmont Park, on Long Island on June 8.

An appeal filed by the owner of Maximum Security, the horse that finished first in the Kentucky Derby on Saturday but was later disqualified for interference, was denied by the Kentucky Horse Racing Commission on Monday.

"No, we're not going to run in the Preakness", West said Monday on NBC's Today morning show.

The appeal was filed by an attorney for Gary West, whose horse became the first victor to be disqualified for an on-track infraction.

"If the state racing commission refuses to hear about it, I think this is something that's big enough that the entire racing world is looking at this", West told NBC.

"I'm thrilled with (Country House), and I'm happy for everyone who has worked with the horse and I think they deserved the win". Stewards determined Maximum Security impeded the paths of several horses in the race.

Flavien Prat of Country House and Jon Court of Long Range Toddy filed a complaint with the stewards, who then deliberated for 22 minutes before taking down Maximum Security as the victor and replacing him with runner-up Country House.

A search for the fallen man ensued and resulted in his rescue more than two hours later, according to the news release. Kilauea volcano's Halema Crater has an active lava lake that can be seen glowing at dusk along with gas plumes.

"Right after the race, I had the trainer call the stewards and very nicely ask them if they would be willing to visit with us after the races were over", West said.

The notice of appeal argued: "The Stewards' acts in reviewing the 145th running of the Kentucky Derby were arbitrary and capricious and did not comply with applicable administrative regulations".

Controversy is still swirling around the Kentucky Derby as the full ramifications of the disqualification of Maximum Security continue to sink in.

The KHRC's decision can after West's legal team filed the appeal to the commission based in Lexington, Kentucky. It was the first such disqualification in Derby's 145 years. But a postrace objection resulted in the track stewards demoting Maximum Security to a 17th-place finish and awarding the garland of roses to Country House and the $1.86 million winner's check to the colt's owner.

Country House's jockey, Flavien Prat, said the reversal was the correct decision. As a result, the horse was placed 17th and Country House, a 65 to 1 longshot, was named the winning horse.

"He said, 'We've been doing this for 40 years and in 22 minutes they took it all away from us. Mr".

On Monday, West blamed fellow competitor Will to Win, which ran from the No. 1 post position, for causing the chaos that saw Maximum Security penalized. "To do it basically straight and have a horse come down so he can win, that was a miracle". "Horse people counted on the excitement of the Derby to obscure the fact that 23 horses died at Santa Anita this winter, and Churchill Downs, too, is one of the deadliest tracks in America".
